1. About these terms

These Terms of Service ("Terms") govern your use of the Edinburgh Festival Jobs website at www.edinburghfestivaljobs.com ("the Site"), operated by Edinburgh Festival Jobs ("we", "us", "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Definitions

  • Recruiter: A registered user who posts job listings on the Site.
  • Applicant: Any person who views job listings or submits an application through the Site.
  • Listing: A job advertisement posted by a Recruiter on the Site.
  • Credit: A pre-purchased entitlement to post a Standard Listing.

3. Recruiter accounts

To post a Listing, you must create an account by providing accurate and complete information including your company name, email address, and a password. You are responsible for maintaining the security of your account credentials. You must not share your account or allow others to access it. We may suspend or terminate accounts that we reasonably believe are being misused.

4. Job listings

Recruiters are solely responsible for the content of their Listings. All Listings must:

  • Relate to genuine, lawful employment or volunteering opportunities
  • Comply with the Equality Act 2010 and all applicable UK employment law
  • Not contain misleading, false, or discriminatory content
  • Not advertise roles that require applicants to pay a fee to apply or work

We reserve the right to remove any Listing that breaches these requirements or that we consider inappropriate, without refund.

5. Payments and pricing

Listing fees are displayed on our Pricing page and are charged in GBP. Payments are processed securely by Stripe. By making a payment, you agree to Stripe's terms of service.

Listing fees are non-refundable once a Listing is published, except at our sole discretion. If you purchase bundle Credits, they do not expire but are non-refundable and non-transferable.

We reserve the right to change our pricing at any time. Price changes will not affect Listings or Credits already purchased.

6. Applicants

Applicants may browse Listings without creating an account. By submitting an application, you consent to your application details (name, email, phone, cover message, and CV) being shared with the Recruiter who posted the Listing.

We do not verify the identity of Recruiters or the accuracy of Listings. We recommend that Applicants exercise their own judgement and caution when applying for roles.

7. Intellectual property

The Site, its design, logo, and content (excluding user-submitted Listings and applications) are owned by Edinburgh Festival Jobs. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

By posting a Listing, you grant us a non-exclusive licence to display, distribute, and promote your Listing on the Site and on our social media channels for the duration of the Listing.

8. Limitation of liability

The Site is provided "as is" without warranty of any kind. To the fullest extent permitted by law:

  • We do not guarantee that the Site will be available, error-free, or secure at all times.
  • We are not liable for any loss arising from the use of the Site, including but not limited to loss of data, revenue, or business opportunity.
  • We are not responsible for the conduct of Recruiters or Applicants, or for the outcome of any employment relationship facilitated through the Site.
  • Our total liability to you shall not exceed the amount you have paid to us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

9. Prohibited conduct

You must not:

  • Use the Site for any unlawful purpose
  • Scrape, crawl, or harvest data from the Site by automated means without our consent
  • Attempt to gain unauthorised access to our systems
  • Post spam, malware, or misleading content
  • Impersonate another person or entity

10. Termination

We may suspend or terminate your account at any time if we believe you have breached these Terms. You may close your account at any time by contacting us. Termination does not entitle you to a refund for unused Listings or Credits.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via the email address associated with your account. Continued use of the Site after changes constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of Scotland and the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
